The Associated General Contractors of America (AGC) is looking for a highly motivated and experienced attorney to join our team as Counsel, Construction & Insurance Law.
As a vital member of the Risk Management team, the Counsel-Construction & Insurance Law will provide legal and risk management expertise to support AGC members, with a focus on construction contracts (including leading AGC’s work on ConsensusDocs development and revisions), insurance, and other risk financing tools. The Counsel will also support AGC’s litigation and advocacy initiatives in areas of construction and insurance law, as well as co-lead AGC’s flagship Surety Bonding & Construction Risk Management Conference and related peer meetings and develop best practice resources. The position reports to the General Counsel and works closely with other AGC departments, outside counsel, and member committees.
Key Responsibilities:
- Act as AGC’s subject matter expert on construction law, contracts, procurement, project delivery methods (e.g., CM At-Risk, Progressive Design-Build) and dispute resolution, including leading ConsensusDocs development, advising on contract risk allocation, and tracking litigation and hot topics/reform trends.
- Develop and deliver programming, resources, and guidance on contract risk allocation, project delivery, and claims management, including practical training on ConsensusDocs, comparisons to other form contracts, and updates to AGC’s State Law Matrix.
- Develop and deliver programming, resources, and guidance on insurance, surety, and emerging risks, while engaging with carriers, brokers, and members to identify industry best practices.
- Co-lead the Surety Bonding & Construction Risk Management Conference, support peer groups and committees, and oversee program content, speaker selection, and sponsor/partner relationships.
- Contribute to AGC’s litigation, amicus briefs, and policy advocacy on contract, insurance, and surety matters, collaborating across departments on regulatory and cross-cutting legal issues.
- Serve as a trusted resource to members by publishing articles, delivering presentations, representing AGC in key construction law forums and conferences, and responding to inquiries, ensuring timely guidance on construction contracts, insurance, and risk management issues.
Requirements
Required:
- A Juris Doctor (JD) degree from an accredited law school with admission to practice law in at least one U.S. jurisdiction.
- 4-5+ years of experience in construction, insurance, or surety law (law firm, in-house, or trade association).
- Strong knowledge of contracts negotiation, risk allocation, and construction law principles.
- Knowledge of insurance coverage and risk management.
- Demonstrated ability to develop educational content and manage large programs/events.
- Excellent legal writing, presentation/public speaking, and interpersonal skills.
- Ability to manage multiple projects and deadlines in a fast-paced environment.
- Ability to translate complex legal concepts into clear, actionable strategies/takeaways for non-legal stakeholders.
Preferred:
- Experience developing and delivering educational programs or compliance tools.
- Experience in the construction industry or with trade associations.
